The deal, in plain words.

These Terms are the agreement between you and Yoink, and they include the end user licence agreement (EULA) for the Yoink app.

1. Your agreement with us

These Terms of Use (“Terms”) form a binding agreement between you and Yoink (“Yoink”, “we”, “us”) governing your use of the Yoink mobile app, the yoinkapp.co website, and everything we provide through them (together, the “Service”). By downloading, opening or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

Our Privacy Policy explains how we handle your information and forms part of these Terms.

2. What Yoink is (and isn’t)

Yoink helps you find things people are giving away for free near you. Listings come from two places:

• Yoink community listings posted by other Yoink users.
• Listings published publicly on other platforms, which we index, attribute, and link out to. To claim those items you leave Yoink and deal with the source platform under its own rules.

Yoink is a directory, not a marketplace. We do not sell anything, do not take payment for items, do not host or process transactions between users, do not deliver, inspect, store or take possession of any item, and are not a party to any agreement between a giver and a taker. Any exchange is strictly between the people involved, at their own risk.

Everything on Yoink is meant to be free. Nobody may ask you for money, deposits, delivery fees, gift cards or payment details for an item listed on Yoink. Any such request is a scam — do not pay, and report it (see section 6).

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use Yoink. You may not use the Service if we have previously banned you, or if the law of your country prohibits it. By using Yoink you confirm you meet these requirements.

4. Your account

• You may browse as a guest, or sign in with Apple, Google or email.
• Keep your credentials secure. You are responsible for activity that happens under your account.
• Provide accurate information and keep it up to date. Do not impersonate anyone, and do not create an account on someone else’s behalf or to evade a ban.
• You may delete your account at any time from Profile → Delete account, or by emailing hello@yoinkapp.co.

5. Community rules

You agree not to post, send, upload or do any of the following on Yoink:

• Objectionable content— content that is unlawful, defamatory, obscene, pornographic, sexually explicit, hateful, discriminatory, violent, graphic, threatening, harassing, bullying, or that promotes self-harm, terrorism or any illegal act.
• Child sexual abuse material or the sexualisation of minors, in any form. This is reported to the relevant authorities.
• Prohibited items— weapons, ammunition and their parts; illegal drugs, controlled substances and paraphernalia; prescription medicines; tobacco, vapes and alcohol; live animals; human remains or bodily fluids; hazardous, recalled or unsafe goods; stolen, counterfeit or otherwise illegal goods; personal or financial documents; anything you do not own or have the right to give away.
• Anything for sale, or listings that solicit money, payment details, deposits, delivery charges, donations or gift cards.
• Harassment or abuse of other users, including sexual advances, hate speech, threats, doxxing, or contacting someone after they have asked you to stop.
• Other people’s personal information, posted without their consent.
• Spam and manipulation— bulk or repetitive posting, misleading titles or photos, fake listings, commercial advertising, referral links, or listing an item you have already given away.
• Abuse of the Service— scraping, crawling, bulk extraction of listings, reverse engineering, bypassing our paywall or rate limits, circumventing security, probing our systems, introducing malware, or using bots or automated access.
• Misuse of third-party sources— using Yoink to breach another platform’s terms, or to contact people in ways they have not agreed to.

6. Reporting, moderation and enforcement

We have a zero-tolerance policy for objectionable content and abusive users.

• Report a listing, a message or a user using the report option in the app where available, or by emailing privacy@yoinkapp.co with a link or screenshot.
• We review reports of objectionable content and abusive behaviour and act on them within 24 hours: removing the content, and ejecting the user who provided it where appropriate.
• Block a user by using the block option in the chat, or by emailing us; a blocked user cannot contact you again.
• We may remove any content, restrict features, or suspend or terminate any account at our discretion, with or without notice, if we believe these Terms have been broken or that someone is at risk.
• Content in Yoink is user-generated or gathered from public third-party listings. We do not pre-screen it, and we do not guarantee that it is accurate, lawful or inoffensive. Please use your judgement.

If you believe content on Yoink infringes your copyright or other rights, or you operate a site whose listings you want removed, email privacy@yoinkapp.co with the details and we will act promptly.

7. Your content

You keep ownership of everything you post. By posting content on Yoink, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, to resize a photo), publish, display and distribute that content, solely for the purposes of operating, promoting within the app, and improving the Service. This licence ends when you delete the content or your account, except for copies retained in backups for a limited period, and except where the content has already been shared with another user.

You confirm that you own or have the rights to everything you post, that it is accurate, that the item exists and is yours to give away, and that posting it does not break any law or anyone’s rights.

8. Meeting people and collecting items

We do not screen, interview or run background checks on users, and we do not verify listings, item safety, condition, ownership or legality. You are solely responsible for your interactions with other people and for anything you take, give away or use.

9. Yoink Unlimited subscription

Yoink is free to download and browse. Some features — including opening listings without limit — require an auto-renewing subscription, Yoink Unlimited.

Payment, renewal and cancellation

• Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• Your subscription renews automatically at the same price and period unless you turn off auto-renewal at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• Manage or cancel your subscription in your store account settings at any time after purchase: App Store subscriptions · Google Play subscriptions. Deleting the app does not cancel your subscription.
• Cancelling stops future renewals. You keep access until the end of the period you have already paid for.
• Free trials: if you buy a subscription during a free trial period, any unused portion of that trial is forfeited when the purchase takes effect. Cancel at least 24 hours before the trial ends to avoid being charged.
• You can restore an existing subscription on a new device with “Restore purchases” in the app, using the same Apple ID or Google account.

Refunds and price changes

• Purchases are processed by Apple or Google, so refunds are handled by them under their policies: Apple support · Google Play refunds. We cannot issue refunds for store purchases directly.
• Nothing here affects your statutory consumer rights, including any right of withdrawal you may have under EU or UK law.
• We may change subscription prices. Where required, changes take effect only after notice and, where the law requires it, your consent — and you can always cancel before a change applies.
• Paying for Yoink Unlimited does not guarantee that any particular item is available, still listed, or that you will receive it. You are paying for access to the directory, not for items.

10. Yoinks (in-app credits)

“Yoinks” are a limited, revocable in-app credit used for actions such as reaching out about a listing. Yoinks have no monetary value, are not your property, cannot be bought, sold, transferred, exchanged, redeemed for cash, or converted into anything of value outside the app, and are not a stored-value or payment instrument. We may adjust, expire or discontinue Yoinks at any time. Any Yoinks balance is forfeited when your account is terminated or deleted.

11. Licence to use the app

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use one copy of the Yoink app on a device you own or control, for your own non-commercial use. This licence is granted by us, not by Apple or Google, and covers only the app as licensed to you.

You may not: copy, modify, translate or create derivative works of the app; reverse engineer, decompile or disassemble it except where the law expressly permits; rent, lease, lend, sell, sublicense or distribute it; remove any proprietary notices; use it to build a competing product; or access it other than through the interfaces we provide.

12. Third-party content and services

Yoink displays listings and links from third parties, and relies on third-party services. We do not control and are not responsible for third-party content, sites, terms, privacy practices, availability, or the items described in third-party listings. When you follow a link out of Yoink, that platform’s own terms apply to you. Any dealings with a third party are solely between you and them.

13. Intellectual property

The Yoink name, logo, app, design, code and content (other than user content and third-party listings) are owned by us and protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you. Third-party names and marks appearing in Yoink belong to their owners and are used for identification and attribution only.

14. Suspension and termination

You may stop using Yoink and delete your account at any time. We may suspend or terminate your access, remove content, or discontinue the Service (in whole or in part) at any time, including if you break these Terms, if we suspect fraud or abuse, or if we must do so for legal or safety reasons. Sections that by their nature should survive termination — including sections 7, 10, 13 and 15 to 22 — survive.

15. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT LISTINGS ARE ACCURATE, CURRENT, LAWFUL OR AVAILABLE, THAT ESTIMATED VALUES ARE CORRECT, OR THAT ANY ITEM WILL BE SAFE, FUNCTIONAL OR SUITABLE. ESTIMATED VALUES ARE AUTOMATED GUIDES ONLY AND ARE NOT APPRAISALS. WE DO NOT ENDORSE OR VET ANY USER OR LISTING.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOINK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THAT PERIOD, OR (B) GBP 50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, you have statutory rights that these Terms do not affect, and some jurisdictions do not allow the exclusions above, so they may not apply to you.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold Yoink harmless from any claims, damages, losses and reasonable costs arising from your content, your use of the Service, your dealings with other users or third-party platforms, or your breach of these Terms or of any law.

18. Changes

We may update these Terms. We will change the date at the top and, for material changes, give notice in the app before they take effect. Continuing to use Yoink after that means you accept the updated Terms. We may also add, change or remove features at any time.

19. Governing law and disputes

These Terms are governed by the laws of the country in which the Yoink operator is established, without regard to conflict-of-laws rules. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of that country.

Before starting formal proceedings, please contact us at privacy@yoinkapp.co— most issues are resolved quickly that way. Consumers in the EU may also use the European Commission’s online dispute resolution platform.

20. Apple-specific terms

These terms apply when you use the Yoink app on an Apple device:

• This agreement is between you and Yoink only, not with Apple. Yoink alone is responsible for the app and its content.
• Your licence to use the app is limited to a non-transferable licence to use it on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Yoink’s responsibility.
• Apple is not responsiblefor addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation, including in connection with the app’s use of HealthKit or HomeKit (which Yoink does not use).
• If a third party claims the app or your use of it infringes their intellectual property, Yoink— not Apple — is responsible for the investigation, defence, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you are not on any US Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
• Questions, complaints or claims about the app should go to hello@yoinkapp.co.

21. Google Play terms

If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app. Subscription payments, renewals and refunds for Google Play purchases are handled by Google under its policies.

22. General

• Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.
• Severability. If any provision is unenforceable, the rest stays in force.
• No waiver. If we do not enforce a right, we do not waive it.
• Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
• No third-party rights, except as stated in section 20.
